Separating From The Military - Unfortunately, there are many cases where military careers end involuntarily. Of course, the worst case would be a soldier facing a general court-martial and dishonorably discharged. However, court martial applies to the most egregious violations of the Uniform Military Justice Act (UCMJ) and is judicial in nature. Administrative separation is most likely when commanders seek to exclude servicemen from military service through non-judicial means. Therefore, it is important to understand not only the difference between the terms "discharge" and "separation", but also what each method of involuntary discharge can mean for a soldier.
Some service members are involuntarily removed from service, through no fault of their own, due to forces beyond their control. For example, if a soldier is seriously injured and cannot return to service after recovery, he or she may be discharged from medical school and enlistment ends earlier than expected. However, when a soldier is involuntarily removed from the military through an administrative separation process, this usually indicates that the soldier has engaged in some type of misconduct.

Court martial is similar to criminal prosecution in the civilian world, but administrative separation is essentially the military equivalent of being fired from your job. Although the situation may not be as severe as a court-martial and the punishment may not be harsh, the effects of administrative separation can be felt for years. It is worth knowing your options for potentially overcoming the situation and maintaining your position in the military.

If the commanding officer decides to initiate administrative separation proceedings against you, the proceedings will begin with a formal written notice. This notice will inform you that the military is seeking administrative separation and will provide the characteristics of your service. This is perhaps the most important element of the process, because the nature of service determines the military benefits still claimed and the potential consequences for civilian life.
The only way active duty military personnel can receive a dishonorable discharge is if they violate the UCMJ and are convicted in ordinary court martial proceedings. It is also important to distinguish between administrative "quarantine" and administrative "immunity". Discharge means that your contract with the military has ended and you are no longer obligated to serve. "Separation" means that a service member may have unfulfilled service obligations.
It is important to note that most administrative separation processes involve involuntary separation. Voluntary administrative separation occurs when an American soldier leaves the military after completing a term of service. Involuntary administrative separation is a non-judicial but formal procedure for removing a soldier from the armed forces. The process begins with the aforementioned administrative separation notice and continues with the separation process.
After receiving this notice, military personnel have the right to consult a military attorney without charge or obtain an outside attorney from a civilian attorney at their own expense. The service member may submit statements in response to the notice, present evidence that contradicts the notice, or adjust witness testimony if the circumstances warrant. When a service member (referred to as the "respondent" in the administrative separation proceeding) submits a legal package to the administrative separation board, the voting members of the board are required to consider and vote on a number of issues before the respondent is separated. or retained in service. The respondent will have the opportunity to testify on his or her behalf, and the respondent or attorney may call witnesses to testify on the matter. The accused or his lawyer may also question other witnesses who have come forward to testify.
The consequences of administrative separation continue even after your military career ends. Depending on what triggered the administrative separation process, you may face additional penalties, including loss of military service benefits. Military service benefits cannot be claimed if a member of the military is discharged or wrongfully discharged in a court-martial process. However, once a military member is administratively separated, the ability to claim benefits is generally left to the discretion of the voting committee handling the separation process.
Alternatively, a voting committee may determine that a soldier served honorably or that the reason for separation was beyond their control and that their service was honorably served. In this case, the soldier can claim most military benefits normally available to discharged soldiers under honor terms or to generals under honor terms.

Administrative separation can also affect civic life. For example, if you can't claim VA benefits because of a military service record violation, you can't get a job or get financial aid for a college education.
